As a landlord in the Netherlands and especially in The Hague there are several rules you need to take into account.
- You must be the owner or have permission from the owner and or homeowners association.
- In some cases a rental permit is required.
- You must comply with rules for temporary rental such as the Vacancy Act or temporary contracts.
- For regulated rental the housing valuation system and maximum rent limits apply.
- For short stay or tourist rental additional municipal rules apply.
Good Landlordship Act
You are also required to comply with the Good Landlordship Act. This means among other things.

- No unreasonable costs or deposits

Service costs
As a landlord you may charge service costs in addition to the basic rent for shared facilities such as cleaning of common areas energy for shared spaces or garden maintenance

- Service costs are not a profit model only actual costs
- You work with a monthly advance payment and an annual settlement
- Tenants have the right to inspect costs and invoices
New rules from July 1 2026
- There will be a fixed list of what can and cannot be charged
- More transparency and a standardized settlement
- Less room for interpretation and fewer disputes
- In short more clarity for both tenant and landlord
Tax obligations depend on how you rent out your property
- Long term rental box 3: The property is usually taxed in box 3 based on its value not on rental income
- Temporary rental or short stay: In some cases income may be taxed as income in box 1
- Tourist rental such as Airbnb: You must declare income and possibly comply with VAT rules depending on services
As this differs per situation we recommend consulting an accountant or tax advisor. Of course we can assist you with this.
In The Hague tourist tax applies to short stays such as Airbnb or short stay
Rate indication approximately 6.20 euros per person per night and may change annually.
As a landlord you are responsible for paying this to the municipality.
How it works
- You register with the municipality of The Hague
- You keep track of the number of overnight stays
- You file returns periodically usually quarterly or annually or automatically via Airbnb
- You pay the tax to the municipality
On platforms such as Airbnb the tourist tax is collected automatically.
